Terms of Service
These Terms of Service ("Terms") govern your use of the Rock-It desktop application and the myrockitapp.com website (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.The software license
Rock-It is licensed, not sold. While your subscription is active, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Rock-It on supported macOS and Windows devices for your own professional or personal use. You do not acquire ownership of the software.
2.Subscriptions, billing, and the seller of record
Rock-It is offered on a subscription basis. Current plans are 15 USD per month or 150 USD per year. Payments are processed by our third-party merchant of record, who acts as the seller of record for your purchase, issues your invoice, and handles payment processing and applicable taxes. Your purchase is also subject to the merchant of record's own checkout terms, shown at the time of payment.
Subscriptions renew automatically at the end of each billing period until you cancel. You may cancel at any time, and cancellation stops future renewals. We may change pricing or plans with reasonable advance notice; changes do not affect the period you have already paid for.
3.Free trial
We may offer a free trial so you can evaluate Rock-It before subscribing. When a trial ends, the application may switch to a limited or read-only state until you start a paid subscription. Your saved files remain on your device.
4.Acceptable use
You agree not to:
- copy, resell, sublicense, rent, or redistribute the Service;
- reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- circumvent, disable, or tamper with licensing, trial, or security mechanisms;
- use the Service for any unlawful purpose or in violation of these Terms.
5.Intellectual property
Rock-It, including its software, design, branding, and content, is owned by us and protected by intellectual property laws. These Terms grant you a license to use the Service, not any ownership rights. The show files, fixture data, and paperwork you create with Rock-It belong to you.
6.Your files and backups
Rock-It works locally on your device, and your show files are stored on your own computer. You are responsible for maintaining backups of your files. We are not responsible for any loss of data on your device.
7.Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fit for use in any safety-critical context. You are responsible for verifying any output before relying on it in a live production environment.
8.Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the twelve months before the claim arose.
9.Suspension and termination
We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm or legal exposure. You may stop using the Service at any time by cancelling your subscription and uninstalling the application.
10.Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept the revised Terms.
11.Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law rules.
